The direct answer

For tax years beginning after 2024, eligible domestic research or experimental expenditures may be currently deductible under Section 174A. Classify software development costs carefully, distinguish domestic from foreign work, and coordinate any research credit or prior-year capitalization method.

Work through the facts

A software company incurs domestic developer payroll, foreign contractor costs and routine SaaS subscriptions. Classify each stream separately under the current research-expense rules and any other applicable capitalization rules before calculating a current deduction or research credit.

Domestic location is not decided solely by the customer's address or the software's eventual users. Identify where the development activity occurs, who performed it and whether the costs are research expenditures. Prior capitalized domestic costs may raise transition questions under current guidance. Have the tax calculation and research-credit workpaper use consistent project and wage data.

A research credit does not automatically follow from a Section 174A deduction, and foreign development has different treatment.

Records to prepare

Keep project descriptions, employee time records, contractor location, invoices, capitalization schedules and prior Section 174 filings.

Compare the available choices on the same set of facts, including current-year tax, later-year effects and administrative cost. A hypothetical illustration is not a filed client result or a promised tax saving.

Primary reference and next step

Review the official guidance for the relevant tax year. The entity documents, complete return, actual transactions and applicable state rules should be checked before implementation.
